ART WORKS Projects (“AWP,” “we,” “us,” or “our”) respects your privacy and is committed to handling personal information responsibly and transparently.

AWP is a nonprofit visual-arts and human-rights organization operating from Chicago, Illinois, United States, and The Hague, Netherlands. This Privacy Policy explains what information we may collect through artworksprojects.org and related online services, why we collect it, how we use and share it, and the choices and rights available to you.

1. INFORMATION WE COLLECT

Depending on how you interact with AWP, we may collect information that you provide directly to us, including:

  • your name;

  • email address;

  • organization or affiliation;

  • contact information;

  • messages, inquiries, or other correspondence;

  • event or program information;

  • newsletter subscription information;

  • information submitted through volunteer, internship, partnership, or other participation forms;

  • donation-related information provided through third-party donation services; and

  • information and media submitted to the Year 20 Inspiration Board, including titles, creator or source information, web links, descriptions, uploaded files, and your explanation of why a work moved or inspired you.

We may also automatically receive limited technical information when you visit our website, such as browser type, device information, referring pages, approximate geographic information, and website usage data.

2. THE YEAR 20 INSPIRATION BOARD

Visitors may submit art, photography, film, journalism, audio, links, or other media for possible consideration for AWP’s Year 20 Inspiration Board and related programming.

Submitting material does not guarantee publication, exhibition, promotion, or other use by AWP.

If you upload media, you must confirm that you created the material or otherwise have permission to share it. By completing the submission permission field, you authorize AWP to review, reproduce, and share the submission for the Inspiration Board and Year 20 programming as described in that form.

Personal contact information submitted with an Inspiration Board entry is used primarily to review the submission, communicate with you, administer the program, and document permissions. We will not add you to our marketing mailing list solely because you submitted material to the Inspiration Board.

3. HOW WE USE INFORMATION

AWP may use personal information to:

  • respond to questions and requests;

  • administer programs, exhibitions, screenings, events, and partnerships;

  • review and manage Inspiration Board submissions;

  • communicate with artists, advocates, partners, supporters, applicants, volunteers, and other members of the AWP community;

  • send newsletters and program updates when you have subscribed or otherwise authorized us to do so;

  • process and maintain records of charitable contributions;

  • improve our website and understand how visitors use it;

  • protect the security and integrity of our website and systems;

  • maintain appropriate organizational, financial, historical, and program records; and

  • comply with legal, regulatory, tax, reporting, or contractual obligations.

We do not sell personal information to advertisers.

4. LEGAL BASES FOR PROCESSING IN EUROPE

Where the European Union General Data Protection Regulation (“GDPR”) or other applicable European data-protection law applies, AWP processes personal data only when there is an appropriate legal basis.

Depending on the circumstances, that basis may include:

Consent. For example, when you subscribe to marketing communications or expressly authorize a particular use of submitted material.

Legitimate interests. For example, communicating with our community, administering nonprofit programs, responding to inquiries, maintaining organizational records, protecting our systems, and improving our work, provided those interests are not overridden by your rights and freedoms.

Contractual or pre-contractual necessity. Where processing is necessary to carry out an agreement with you or take steps you have requested.

Legal obligations. Where we must retain or disclose information to comply with applicable law, tax requirements, financial reporting, court orders, or other lawful obligations.

You may withdraw consent at any time where our processing depends on consent. Withdrawal does not affect processing that was lawful before consent was withdrawn.

5. NEWSLETTER AND EMAIL COMMUNICATIONS

If you choose to subscribe to ART WORKS Projects news, event announcements, or program updates, we may collect your name, email address, and related subscription preferences.

We use third-party email service providers, including Mailchimp and Emma (Marigold), to manage these communications. These providers may process your information on our behalf in accordance with their own privacy and security practices.

Newsletter subscription is separate from submitting an Inspiration Board entry, contacting AWP, making a donation, registering for an event, or otherwise participating in an AWP program.

You may unsubscribe from marketing communications at any time by using the unsubscribe link included in those messages.

6. DONATIONS

AWP uses third-party services to accept and process charitable contributions.

When you make an online donation, payment information, such as credit or debit card details, is generally collected and processed directly by the payment or donation provider rather than stored by AWP.

AWP may receive information necessary to acknowledge and administer your contribution, such as your name, contact information, donation amount, date, and other information you choose to provide.

Third-party donation and payment providers maintain their own privacy policies and security practices.

7. EVENTS AND EXTERNAL REGISTRATION SERVICES

AWP may use third-party platforms, including Eventbrite, to manage event registration for ticketing, screenings, exhibitions, workshops, or other programs.

If you follow a link from the AWP website to an external registration, ticketing, or event service, information you provide to that service is also governed by that provider’s privacy policy.

AWP may receive registration or attendance information from those services when necessary to administer an event or program.

8. SERVICE PROVIDERS AND THIRD PARTIES

AWP uses third-party services to help operate our website, communications, programs, and administrative functions. These may include providers of website hosting and administration, file and submission storage, email communications, charitable donation processing, event registration, embedded media, website analytics, and related services.

Current services may include platforms such as Squarespace, Google services, donation-processing platforms including Donorbox, email-service providers, event-registration platforms, and video or social-media services.

These providers may process personal information on our behalf or in connection with the services they provide.

AWP may also disclose information when reasonably necessary to comply with applicable law, protect the rights or safety of AWP or others, investigate fraud or security concerns, enforce agreements, or respond to lawful governmental, regulatory, or judicial requests.

We do not authorize service providers acting solely on our behalf to use personal information for purposes unrelated to providing their services to AWP.

9. COOKIES AND WEBSITE TECHNOLOGIES

Our website and third-party services incorporated into it may use cookies and similar technologies.

Some cookies are necessary for the website to function properly. Others may help us understand website traffic, remember visitor preferences, provide embedded content, improve website performance, or better understand how visitors interact with AWP content.

Where applicable law requires consent before non-essential cookies or similar technologies are used, we will seek that consent.

Visitors may also adjust cookie settings through their web browsers and, where available, via the cookie controls on the AWP website.

Disabling certain cookies may affect how some website features function.

10. INTERNATIONAL DATA TRANSFERS

ART WORKS Projects operates from both the United States and the Netherlands and works with artists, partners, audiences, and service providers internationally.

As a result, personal information may be processed, transferred, or stored in countries other than the country in which you originally provided it. Those countries may have different privacy and data-protection laws.

Where European data protection law applies and personal data is transferred outside the European Economic Area, AWP and its service providers will use an appropriate lawful transfer mechanism, where required, such as an adequacy decision, Standard Contractual Clauses, or another legally recognized safeguard.

11. HOW LONG WE KEEP INFORMATION

AWP retains personal information only for as long as reasonably necessary for the purposes for which it was collected, including program administration, communications, organizational history, financial and tax obligations, dispute resolution, legal compliance, and other legitimate nonprofit purposes.

Retention periods vary according to the nature of the information.

Newsletter information may generally be retained until you unsubscribe or request deletion, subject to retaining only the limited records necessary to ensure that your unsubscribe request continues to be honored.

Donation and financial records may be retained for the period required by applicable accounting, tax, nonprofit, or other legal obligations.

Program, partnership, and organizational correspondence may be retained while relevant to AWP’s work, institutional history, or legitimate operational needs.

Inspiration Board submissions and related permissions may be retained while a submission is under consideration and, if selected or used, for as long as reasonably necessary to document permission to use the work and preserve AWP’s program history.

Certain records may be retained longer where required by law or reasonably necessary to establish, exercise, or defend legal claims.

12. YOUR PRIVACY RIGHTS

Depending on where you live and which privacy laws apply, you may have rights regarding personal information that AWP maintains about you.

These may include the right to know whether we process personal information about you; request access to that information; correct inaccurate or incomplete information; request deletion; restrict or object to certain processing; receive certain information in a portable format; withdraw consent where processing is based on consent; and object to direct marketing.

We may need to verify your identity before fulfilling certain requests.

Where the GDPR applies, requests will be handled in accordance with applicable European data-protection requirements.

If you are located in the European Union or European Economic Area, you may also have the right to lodge a complaint with the appropriate national data-protection authority. In the Netherlands, that authority is the Autoriteit Persoonsgegevens (Dutch Data Protection Authority).

13. SECURITY

AWP takes reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, disclosure, alteration, misuse, destruction, or loss.

No website, electronic transmission, cloud-storage system, or other method of storing information can be guaranteed to be completely secure. Accordingly, while we take reasonable precautions, we cannot guarantee absolute security.

14. CHILDREN’S PRIVACY

The general AWP website is not designed to knowingly collect personal information from young children without appropriate authorization.

AWP programs may occasionally involve children or young people. When a specific program requires information from or about minors, additional consent, parental or guardian permission, safeguarding, or privacy procedures may apply.

If you believe that a child has inappropriately provided personal information to AWP, please contact us so we can review the situation and take appropriate action.

15. LINKS AND EMBEDDED CONTENT

The AWP website may contain links to or embedded content from websites, videos, social-media services, ticketing platforms, donation platforms, news organizations, artists, partner organizations, and other third parties.

When you interact with those external services, they may collect information independently of AWP.

AWP does not control the privacy, security, or data-handling practices of those third parties. We encourage visitors to review the privacy policies of external services before providing personal information to them.

16. CHANGES TO THIS POLICY

AWP may update this Privacy Policy periodically as our programs, website, technology, service providers, or legal obligations change.

When we make changes, we will update the Effective Date displayed at the top of this page.

If we make material changes affecting how personal information is used, we may provide additional notice when appropriate.
